Welcome to Menutiq, a digital menu management platform provided by Software and Operation Solutions. These terms of service govern your use of our website, application, and services. By creating a Menutiq account and using our services, you confirm that you have read, understood, and agreed to be bound by these terms of service. If you are using the service on behalf of an organization, you confirm that you are authorized to accept these terms on behalf of that organization.

Description of Services

Menutiq is a platform that allows restaurants, bars, cafeterias, and food establishments to create, manage, and share digital menus accessible via QR codes. Our services include menu creation, dish and category management, multi-language support, allergen management, and QR code generation for menu access.

User Accounts

To use Menutiq, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other security breach. We will not be liable for any losses resulting from unauthorized use of your account.

We reserve the right to suspend or terminate your account if we find that you have violated these terms of service or if your behavior is harmful to other users or our service.

Subscriptions and Payments

Menutiq offers different subscription plans with various features and pricing. Details of each plan are available on our website.

By subscribing to a plan, you agree to pay the applicable fees according to the chosen plan. Payments are typically billed monthly or annually, depending on the option you selected.

The prices of our services may be changed at any time. We will notify you of any price changes at least 30 days before they take effect.

If you fail to pay the fees on time, we reserve the right to suspend or terminate your access to our services.

Subscription Cancellation

You can cancel your subscription at any time through your dashboard or by contacting our customer service at support@menutiq.com.

When you cancel your subscription, it remains valid until the end of the current billing period. For example, if you are billed on the 7th of the month and you decide to cancel your subscription on the 15th, you can continue to use all services until the 7th of the following month.

No partial refunds are provided for unused subscription periods unless required by applicable law.

User Content

By using Menutiq, you may upload and share content, including dish names, descriptions, prices, and images. You retain all rights to this content, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, publish, and distribute this content as part of providing our services to restaurants, bars, cafeterias, and food establishments.

You are fully responsible for the content you share through our service. You warrant that you own all necessary rights to this content and that it does not violate third-party rights or applicable laws.

We reserve the right to remove any content that violates these terms or that we deem inappropriate, without notice.

Intellectual Property

Menutiq and its original content, features, and functionality are and will remain the exclusive property of Software and Operation Solutions and its licensors. The service is protected by copyright, trademark, and other laws in France and abroad. Our trademarks and trade dress may not be used without our prior written permission.

Prohibited Uses

You agree not to use Menutiq for any illegal or prohibited activity by these terms. This includes, but is not limited to, posting defamatory, obscene, or fraudulent content, violating others' intellectual property rights, attempting unauthorized access to our systems, or using our service to distribute malware or spam.

Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these terms of service. Upon termination, your right to use the service will cease immediately.

Limitation of Liability

To the maximum extent permitted by applicable law, Software and Operation Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

Disclaimer of Warranties

Your use of the service is at your sole risk. The service is provided 'as is' and 'as available'. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or performance.

Governing Law

These terms shall be governed and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any dispute arising from these terms shall be subject to the exclusive jurisdiction of the courts of Paris, France.

Changes to Terms

We reserve the right to modify or replace these terms at any time. If a revision is material, we will provide at least 30 days' notice before the new terms take effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our service after those revisions become effective, you agree to be bound by the revised terms.
